这是今年秋天上海一个病毒式传播事件背后的故事线，也是重新点燃公众长期不满情绪的火花。

That is the storyline behind a viral moment in Shanghai this fall, but also a spark that has reignite a long standing public irritation.

许多居民从未同意也无法躲避的电梯广告。

Elevator adds that many residents never approved and can never avoid.

当不满遭遇法律模糊时，问题就变成了：个人权利、商业权利与社区权利究竟在何处交汇，谁又拥有最终决定权？

When frustration meets legal ambiguity, the question becomes, where exactly do personal rights, commercial rights, and also community rights intersect, and who gets the final say?

But first, elevator rides used to be the city's last pocket of peace.

如今它们成了迷你时代广场——少了那份喧嚣，却有着同样密集的闪烁屏幕。

Now they are a miniature Times Square, minus the excitement, but with the same amount of flashing screens.

So when one college student decided to shut down noise pollution one elevator at a time, the Internet cheered, though lawyers frowned.

It turns out that turning off the ads is easy.

Figuring out who has the legal right to do so is the hard part.

所以我有很多疑问。

So I have so many questions.

How did he do it?

Where did he get the key?

Exactly.

Why would he go so extreme in doing so?

Is that illegal?

但在回答这些问题前，究竟发生了什么？

But before answering all these questions, what exactly happened?

Yeah.

事实上，今年十月，上海一名大三学生受够了他们楼里无休止播放的嘈杂电梯广告，于是用他在网上仅花10元购买的万能钥匙采取了行动。

Actually, this October, a college junior in Shanghai decided that he had had enough of the noisy elevator advertisements that blared endlessly in their building with that universal key that he bought online for just 10 yuan.

大概相当于1美元40美分。

That's about a dollar and 40.

So just to kind of paint a picture here, a lot of the community complexes, the apartment complexes, in the elevator, they'll have a screen that's not built into the wall.

Think of it like, I don't know, like a small computer monitor or something like that.

And through that screen, they'll companies will pay to advertise their products, and the companies are you know, they they vary.

Sometimes, yes.

The speaker volume is a considering little the confined space that you're in, it can be a little intrusive to your ears.

So to this college kid, he said enough is enough.

He bought a universal key online, and he, like you said, five days just shutting these things down.

That's the point that I'd like to mention.

This is the separate screen that these advertisement provider are providing, for these elevator.

And then because these screens aren't part of the elevator's original system, it, can be seen as safe if you just shut the screen down.

He was only simply turning off the screens just like you would turn off your computer screen, although he you do need a special key for that.

I've been wanting to do that for a long time and but, of course, this is not a, like, encouraged behavior that the community is want him to do.

Right?

投放这些电梯广告的公司最初宣称其广告是'高关注度低干扰'，但仍有大量居民表示广告声控音量过大影响了他们的生活。

The company who put out these elevator ads in the first place describes it's ad as high attention and low interference, but still, a lot of people are saying that you're just the the the sound, the is just too loud and it is affecting their live and even though I personally, I don't think they are that annoyed because you will stay in that elevator for probably less than one minute Mhmm.

可能一天要关两次。

Maybe two times a day.

是啊。

Yeah.

我勉强能忍受，但有些广告确实会不断重复，让你想起那些反复播放同一句广告词的童年广告，只为让你记住品牌名。

I can kind of bear that, but still, if because some of these advertisements can be really repetitive and reminds you of some childhood advertisement that's saying that same line again and again just want you to remember that brand name.

所以我理解这种情绪。

So I understand that kind of sentiment.

The reason that people are debating over it is because many residents would consider the area of an elevator in their own building directly to their homes somewhere semi public and semi personal.

As a homeowner of the community, of the residential community, We feel like we have a say somehow in whether or not we agree in having those ads being put on in our elevators.

这些广告的收益归谁所有？

Who is getting the money out of these ads?

Are we being benefited?

或许至少部分广告收入用于支付社区工作人员的薪资。

Maybe you're using the money to part of the money, at least, to pay for the staff working in the community.

但我们在法律上、权利上是否有发言权？有没有任何途径或方式能让我们参与讨论并做出这些决定？

But do we have a say legally, rightfully, anything that we can or is there any path, any any way for us to have a discussion in making these decisions?

在社区公共区域投放广告是有正规流程的。

There are, like, legitimate process when you want to put advertisement in that public area in this community compound.

对吧？

Right?

简单来说，在电梯投放广告前必须满足三个条件。

In simple terms, three things that must happen before placing elevator advertisements.

第一，业主们需要共同决定是否同意在社区投放广告，所有相关方必须达成一致；第二，广告内容本身必须合法合规。

One, homeowners have to decide together whether they'd like that in the community or not, and all parties involved needs to agree for it to happen, and the ads themselves must be legal and compliant.

由于电梯属于共有财产，将其改造为广告位相当于在全体业主共有的区域开展商业活动，这需要极高比例的业主同意。

And because elevators are shared property, right, and turning them into ad space is considered running a business in an area owned by every single one living in this residential area, and that requires a very, very high level of approval.

不是简单投票就行，至少需要三分之二业主参与表决，其中四分之三投赞成票——这其实是民法典的规定。

Not just a simple vote, at least two thirds of the homeowners must participate, and among those who vote, three quarters have to say yes, and that's actually in the civil code.

是的。

Yeah.

而且你们还需要物业公司与业主沟通，在安装屏幕或出租广告位之前获得他们的同意，对吗？

And you also need the property management company to talk to the homeowners and get their consent before they install the screens as well or renting out that space at all?

作为住宅小区的业主或居民，我个人觉得如果屏幕不像全身镜那么大、避不开，并且不会对着我闪烁刺眼、伤害孩子的视力，那我可以接受。

So as a homeowner or a resident in the residential community, personally, my feeling is that if the screen is not as big as a full body mirror that I cannot avoid and it's flashing at me, it's very bright, it hurts the eyesight of my kid, that is fine.

还有如果声音不太大，我也能接受。

And also if the sound is not too loud, that is fine.

再比如，如果屏幕内容不太低俗或不适合孩子观看，在这些情况下我会投赞成票。

And also if, for example, the content on the screen is not too cheesy or a bit inappropriate for kids, I will vote for yes in these occasions.

但显然，并非所有住宅楼都是这种情况，所以才引发了投诉。

But apparently, that is not the case in all of the residential community buildings, and that leads to the complaints.

实际上大多数投诉都来自这类极端案例。

Even majority of the complaints comes from these kind of extreme examples.

其实是有相关规定的。

Well, actually, there's a rule.

《广告法》规定广告不得含有虚假、欺骗性内容，不得违背社会公序良俗，不得具有冒犯性或危害性。

There's an advertising law that says the ads are not allowed to be misleading or fake or offensive or harmful or against public order and good morals.

广告主自身有责任确保他们在屏幕上展示的内容真实且合规，以解决你刚才提到的担忧。

The advertisers themselves are responsible for making sure that what they put on those screens is truthful and compliant to address that concern that you just mentioned.

我们在这里还看到哪些其他投诉？

What are some other complaints we're looking at here?

因为我认为，即使广告主遵守了史蒂夫刚才提到的规定，仍然会有人对这些商业广告持反对态度。

Because I would assume even if the advertisers are in line with the regulations that Steve has just mentioned, still, some people would have problems with these kind of ads.

Because they are commercial advertisements.

Right?

When you're placing these commercial advertisements, you can actually make money out of it.

这也是许多业主讨论的问题之一：这些钱去了哪里？

And that is also one of the issues that a lot of these homeowners are discussing, where does that money goes?

因为公共区域属于全体业主共有。

Because that public area belongs to all all the homeowners.

Mhmm.

对吧？

Right?

你们是在利用物业管理部门将公共区域用于商业行为。

And you are making and you are using the management property management is using the public area for a commercial behavior.

在中国许多地方，像电梯这类共享空间用于商业广告的收入归全体业主集体所有。

So in many places in China, the income from using these shared spaces like elevators for commercial ads belongs to the homeowners as a collective.

对于社区管理团队来说，在业主委员会成立前后有两个时间节点需要处理。

And for the community management teams, there are two spots on the timeline to meet before and after homeowners association is formed.

在业委会成立前，业主与物业之间的合同应明确这笔收入的用途，比如可能用于小区维护等公共支出；成立后，这部分收益仍可能要与全体业主共享。

So before, it is formed, the contract between homeowners and the property management should specify how this income is handled, like they may use it for maintenance and everything in the community compound, and then, maybe after that, you can still, share this kind of income with all of the homeowners.

是的。

Yeah.

如果物业或广告公司在未经业主同意的情况下擅自安装屏幕，这是不允许的。

If the property management or the advertisement company, if they put up screens without the approval of the the people who who own the homes there, that's not allowed.

但如果他们把全部利润据为己有，那也是不允许的。

But also, if they keep all the profits for themselves, that's not allowed too.

居民甚至可以提起民事诉讼，要求停止广告并返还收入。

And residents can actually go so far as to file a civil lawsuit to demand that the ads stop and that the revenue be returned.

I'm curious.

我作为业主的话，根本不会想到这些事。

I didn't know about I had I wouldn't have even thought about this if I were a homeowner.

我还想了解其他国家的情况，因为我们电梯里似乎也有这类屏幕。

And, also, I wanna know the situation in other countries as well because it seems that we do have these kind of screens in our elevators.

But I do not remember seeing a lot of those.

Or maybe because I haven't visited a friend living overseas, so I haven't seen a residential building I've only

I've only seen them in commercial buildings where you'll find office spaces

Yes.

Where I'm sure that revenue goes back to the owner of and the maybe gets distributed however.

我从未在公寓楼里见过广告。

I've never seen advertisements in an apartment complex before.

话虽如此，如果能一直按计划执行，始终遵守规定，听起来还是合理的。

That being said, if it can go according to plan all the time, according to the regulations all the time, it's it still sounds reasonable.

But let's be honest as a homeowner.

To start with, like Steve said, who would have known this?

Who would have known that the tree planted in our community that can maybe started to harvest allow you to harvest some apples or other kind of fruits can be part of the profit of the entire community.

Well, and Would that not be common

我不知道，因为不同社区的具体情况千差万别。

I don't know because there are so many different details in different communities.

And my next point is maybe we know about this.

但我认为并非每个业主都有时间和精力参与业主委员会的事务。

But we I don't think each and every homeowner would have the time and energy and willingness to join the homeowner's community and to make the vote, to make the complaint.

也许有些人抱着和Steve一样的想法，觉得每天多花一两分钟还能忍受。

Maybe some of them are sharing the same mentality like Yushun saying, one or two minutes, two times a day, can bear with I

我想我理解你的意思。

think I see your point.

当我在韩国住的时候，有公寓楼的管理员上门询问是否要参加社区会议。。

When when I lived in Korea, in one of the apartments that I lived in, they asked me someone came to the door one day and asked, do you wanna come to the community complex meeting?

你想参与吗？

Do you wanna be involved?

我说，哦，绝对不去。

And I said, oh, absolutely not.

看吧？

See?

是啊。

Yeah.

所以我甚至从没考虑过这事，但确实印证了你的观点——可能不是所有人都知道这事，因为不是每个人都加入了社区群聊，对吧？

So I didn't even I've I've never even thought about that, but it does bring up your valid point is that maybe not everyone knows about this because not everyone's involved in the community group chat or right?

But it makes sense.

Maybe they don't know what's going on.

That is why transparency is necessary in this case.

The income and maybe the spending must be accounted for separately and disclosed maybe for a certain amount of time every year or every half year and open to homeowners supervision.

Of course, you don't not you're like of course, the, like, property management encourage you to join that group chat and so that you can know all of the things going on in the community.

How much money they are may they're making from these advertisement, how much money they're spending, from these money, and how much money have left, and how much money can go back to your own account.

And speaking of going back to the community, that case that we mentioned in the very beginning, the student, he eventually revisited one of the residential compounds that was featured in his video.

And it got, like, 4,000 plus likes, and that's where all those comments were coming from saying, oh, yeah.

Maybe we didn't even talk about whether he's allowed to do that or not.

But anyway, he went back, and he and he found that the proper man property management had they had already turned the elevator screens back on.

And they pointed out to him that a notice board in the community's compound details the revenue that the compound receives from such advertisements stating that it is spent exclusively on public maintenance.

So, they made that point to him that, yep, we make money from these advertisements, but we we publicly post it on the community board, and there is a detailed breakdown of where that money goes within it's used within the community.

And here, I'm not pointing fingers at those residents who cheered at the college kids' action yet refused to join the management club or meeting or anything in the first place.

I'm just saying maybe in these kind of cases, when everybody is doing what they're supposed to do, yet also making a choice of not, you know, taking too much care of the issue of the things happening in the community, if we care, we if we care enough to cheer for the college kid, maybe in the future, we can care enough to join the board to have the discussion.

在这个具体案例中，我并不确定社区管理方真的做错了什么。

And the I don't in this specific case, I'm not really sure the community management has done something so wrong.

They have put up the notice, the information, making it transparency.

也许还可以更努力些，让所有居民参与决策过程。

Maybe try also a little harder involving all the residents in the decision making process.

找些更好的广告投放在电梯里。

Find out some better advertisements to put up in the elevator.

我们完全没有在推举这个年轻人，因为这事还没讨论过。

And we are not promoting this young man at all because we haven't discussed this yet.

但这样挨个社区去关电梯广告真的合适吗？

But is it okay to just go around from community to community turning off elevator advertisements?

不合适。

No.

你绝对不能这么做，这种行为会带来法律风险——未经许可使用万能钥匙等工具关闭电梯广告属于民事违规，可能导致损害赔偿诉讼。

You absolutely cannot, and it comes with legal risks if you are going to do something like that because using tools such as the universal key that he acquired, to turn off those elevator ads without permission, that constitutes a civil violation, and that could result in claims, for damages.

My happy place this week was my trip to Yunnan in Southwest China.

I love Yunnan.

I stayed in this warm, culturally rich region where the local aft ethnic traditions are woven into their everyday lives.

You know, I got to taste a completely different style of cuisine.

它带点酸辣，充满了鲜明清爽的滋味。

It's a little bit sour and spicy and full of bold and refreshing refreshing flavors.

Are the dishes different than what you would find in Beijing or are they similar just with different flavorings?

And also, about the environment there is the thing that really inspired me because surrounded by these breathtaking sceneries and bright blue skies especially, I soaked in their natural hot springs.

I lived in that ancient town.

And then I hiked through their untouched rainforest and explored striking, volcanic rock formations.

Each moment helped me unwind layer by layer until I felt both my body and mind gradually reset.

That's pretty far south.

Here in Beijing, it's wintertime has arrived in Beijing.

There's no question about that.

夜间气温在零度左右徘徊，或者零上两三度这样。

The temperatures in at night are hovering around zero or maybe plus two, three, four, something like that.

云南现在是什么天气？

What what is it like now in Yunnan?

暖和多了。

A lot warmer.

虽然昼夜温差很大，但白天我只穿一件衬衫。

Although they have huge, like, temperature differences during the daytime and night, but still, I wear one shirt during the day.

和加拿大差别好大，因为加拿大是横向国家而非纵向的。

Such a huge difference with Canada, because Canada's more more of a horizontal country than it is vertical.

所以最西边温哥华的冬天，和最东边新斯科舍的冬天是一样的。

So wintertime in Vancouver on the Far West is also wintertime in Nova Scotia on the Far East.

但在中国，北方地区已是严冬，而遥远的南方却依然相当温暖。

But in China, you've got, you know, the northern regions where it's full on winter, and then way down south, it's still really quite warm.

这也是在中国各地旅行最有趣的部分之一，因为你能体验到完全不同的气候。

That's also one of the most interesting parts when you're traveling in different places in China because you can experience totally different Yeah.

这次旅行也提醒我们休息非常重要且必要，因为暂时脱离日常，沉浸于如此多样的风景和文化中，让我更深刻地体会到那种平衡、清晰以及感恩之情。

And this trip was also a reminder that rest is quite important and necessary because stepping away from our routine and immersing ourselves in such diverse landscapes and cultures gave me a deeper sense of that kind of balance and clarity and also gratitude.

对于那些还没去过云南的人，尤其是如果你不住在中国，不了解这些地方，你可能会先去北京、上海和成都，但云南是个很棒的地方。

And for those of you who haven't visited Yunnan before, even especially if you're not living in China, you do not know the places, you might wanna hit Beijing, Shanghai, and Chengdu first, but Yunnan is a great place.

我最喜欢云南的一点是，当我游览西双版纳时，我去了植物园，那里也是热带雨林区，我学到了很多关于不同蔬菜、水果和植物的知识。

One of the things that I love the most about Yunnan is when I was visiting Sichuan Bana, I went to the botanical garden, which is also the rainforest area, I learned a lot about different vegetables, different fruits, different plants.

植物很聪明。

Plants are smart.

从长远来看，经过数千年后，它们会在森林中找到自己的完美位置。

In the long run, after thousands of years, they find their perfect spot in the forest.

If they're really tall and standing up there, they absorb the sun, but they also provide a cover, basically, a shed for the other plants.

You can even live on a huge tree, and you would evolve and adapt the shape of your leaves, the size of yourself, and even nutrition you can absorb based on where you are.

But going to these places not only would open a new window for you, it also gives you a fresh perspective in understanding your place in a society, understanding human's position in the nature, and that is also quite valuable.

I've done it before in my life once where I was able to achieve that goal for a pretty significant period of time, and the plan was to start this previous Monday.

Well, I haven't been to the swimming pool just yet, so I failed every single day so far because it would require me to wake up quite a bit earlier in the morning and then get to the pool and then get out, have a shower, and before before I I get to work.

But I'm really excited that the opportunity even exists.

You try to energize yourself even before sunrise, and maybe you can also go to bed early, which is good for your overall health.

And the reason I chose swimming is because I I love swimming more than I can explain.

I love being in the water.

When I go to the beach, the first thing I do is go for a swim, and I could stay in that ocean all day, so that's why I chose it.
